2. MEMBERSHIP TERMS

2.1 Membership Fee

Monthly membership fee is $20.00 every 4 weeks, billed on a recurring basis via ACH and credit card on file. Membership grants access to the FullTime Fairways facility and the online booking portal. Membership does not include complimentary tee times.

2.2 Tee Time Rate

Simulator reservations are billed at $15.00 per hour and are charged separately from the monthly membership fee. Tee times must be reserved in advance through the online booking system.

2.3 Booking Rules

• Members may have a maximum of 2 active bookings at any given time.

• Bookings are limited to 2 hours per session.

• Reservations must be cancelled at least 2 hours in advance to avoid forfeiture of that time slot.

• Late cancellations and no-shows will be forfeited. Emergencies may be handled on a case-by-case basis.

• Members may bring guests. Guests must be accompanied by the member at all times and are the responsibility of the member.

2.4 Membership Commencement

Membership begins on the date this agreement is signed and the first payment is processed. A unique PIN code will be issued to the member upon activation, granting 24/7 facility access.

3. PIN CODE & FACILITY ACCESS

Access to the FullTime Fairways facility is granted exclusively via a personal PIN code issued to each member at the time of enrollment.

• Your PIN code is personal and non-transferable. Sharing your PIN with non-members is a violation of this agreement and grounds for immediate membership termination.

• A new PIN code will be issued each time a reservation is made and sent to the email address on file.

• Member is responsible for all activity that occurs under their PIN code during their reserved time.

• FullTime Fairways reserves the right to deactivate any PIN code at any time for violation of facility rules or this agreement.

• If you believe your PIN has been compromised, contact FullTime Fairways immediately at the contact information provided at sign-up.

4. CANCELLATION & REFUND POLICY

4.1 Cancelling Your Membership

Members may cancel their membership at any time by providing written notice via email or through the member portal. Cancellation will take effect at the end of the current billing cycle. No partial refunds will be issued for unused days within a billing period.

4.2 Refunds

Membership fees and tee time charges are non-refundable unless an error was made by FullTime Fairways (e.g., double billing, system error). Refund requests must be submitted within 7 days of the charge in question.

4.3 Failed Payments

If a scheduled payment fails, FullTime Fairways will attempt to collect payment for up to 5 business days. If payment is not resolved within that period, the membership will be suspended and facility access revoked until the account is brought current.

5. FACILITY RULES & CODE OF CONDUCT

By signing this agreement, the Member agrees to abide by the following rules at all times while on the premises:

• The facility is open 24 hours a day, 7 days a week, 365 days a year.

• All Members and guests must treat the facility, equipment, and other members with respect.

• BYOB (Bring Your Own Beverage) is permitted. Members are responsible for cleaning up after themselves and their guests. Excessive mess or damage caused by alcohol consumption may result in membership termination. All alcoholic beverages must be removed from the premise when members leave to avoid underage members/guests from accessing them.

• Smoking, vaping, and use of illegal substances on the premises are strictly prohibited.

• Members may only occupy their reserved simulator bay. Do not use bays that are not part of your reservation.

• Children under the age of 18 must be accompanied by an adult member at all times.

• Loud, disruptive, or abusive behavior will not be tolerated and may result in immediate removal and membership termination.

• Do not tamper with, adjust, or remove any equipment, wiring, signage, or facility infrastructure.

• Vending machine purchases are made at the member's own discretion. No refunds are issued for vending machine transactions.

• All trash must be disposed of in designated receptacles before leaving. Members are expected to leave bays in the condition they were found.

6. DAMAGE & VANDALISM POLICY

Members are financially responsible for any damage to FullTime Fairways property caused by themselves or their guests during their reserved time, including but not limited to:

• Damage to impact screens, netting, or projection equipment.

• Damage to simulator hardware, touchscreens, computers, or launch monitors.

• Damage to furniture, turf, walls, or any other facility infrastructure.

• Theft of any equipment or supplies from the facility.

FullTime Fairways reserves the right to charge the Member's payment method on file for the full cost of repair or replacement of any damaged or stolen items. Evidence from security cameras or other monitoring systems may be used to assess responsibility. Deliberate vandalism will result in immediate membership termination and may be reported to law enforcement.

7. LIABILITY WAIVER & ASSUMPTION OF RISK

THE MEMBER ACKNOWLEDGES AND AGREES TO THE FOLLOWING:

7.1 Assumption of Risk: Participation in golf simulator activities involves physical activity and carries inherent risks, including but not limited to personal injury from equipment, errant shots, slipping, or other accidents. The Member voluntarily assumes all such risks.

7.2 Release of Liability: To the fullest extent permitted by law, the Member hereby releases, waives, and discharges FullTime Fairways, its owners, partners, agents, and assigns (collectively "FullTime Fairways") from any and all claims, demands, damages, costs, or causes of action arising out of or related to the Member's use of the facility, whether caused by negligence or otherwise.

7.3 Indemnification: The Member agrees to indemnify and hold harmless FullTime Fairways from any claims arising out of the Member's use of the facility, including claims by guests brought by the Member.

7.4 No Medical Advice: FullTime Fairways does not provide medical or fitness advice. Members with pre-existing health conditions should consult a physician before engaging in physical activity at the facility.

7.5 Surveillance: The Member acknowledges that the facility is monitored by 24/7 security cameras for safety and security purposes. By entering the facility, the Member consents to being recorded.

8. GOVERNING LAW & DISPUTE RESOLUTION

This Agreement shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any dispute arising out of or related to this Agreement shall first be submitted to good-faith mediation between the parties. If mediation is unsuccessful, the dispute shall be resolved through binding arbitration in the county in which the FullTime Fairways facility is located. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.

If any provision of this Agreement is found to be unenforceable, the remaining provisions shall remain in full force and effect.

9. ACKNOWLEDGMENT & AGREEMENT

By signing below, I acknowledge that I have read, understood, and agree to all terms and conditions of this FullTime Fairways Membership Agreement. I understand that this is a binding legal agreement.
